This Policy applies to information collected through www.ManagementInsightsGroup.com (the “Site”), through our accounting, business analytics, customer management, donor management, back-office, and annual reporting services, and through any other written, verbal, telephonic, or electronic communication between you and Management Insights Group.

This Policy is drafted to comply with the laws of the State of Texas, including the Texas Data Privacy and Security Act, Tex. Bus. & Com. Code ch. 541 (the “TDPSA”), and the Texas Identity Theft Enforcement and Protection Act, Tex. Bus. & Com. Code ch. 521. By accessing the Site, submitting information through an application form (including the Accounting Application), engaging Management Insights Group for professional services, or otherwise providing personal information to us, you acknowledge that you have read and understood this Policy. If you do not agree with the practices described herein, we ask that you refrain from submitting personal information to us and, where applicable, discontinue use of the Site.

3. OUR COMMITMENT TO PROTECTING YOUR PRIVACY

Management Insights Group will take all reasonable and customary precautions, consistent with prevailing industry standards for a professional services firm of our size and scope, to protect the confidentiality, integrity, and security of the personal information you share with us in the course of doing business. These precautions include, without limitation, the use of administrative, technical, and physical safeguards designed to prevent unauthorized access, disclosure, alteration, or destruction of personal information, restriction of access to personal information to personnel with a legitimate business need, and secure handling of financial and accounting records consistent with generally accepted accounting and data-handling practices.

Notwithstanding the foregoing, no method of electronic storage or transmission over the internet is, or can be represented to be, one hundred percent (100%) secure. Accordingly, while Management Insights Group strives to use commercially reasonable and industry-customary means to protect your personal information, we cannot guarantee its absolute security, and we disclaim liability for unauthorized access or disclosure resulting from circumstances beyond our reasonable control.

4. NO SALE OF PERSONAL INFORMATION

Management Insights Group will not sell, rent, lease, or otherwise transfer your personal information to any third party for monetary or other valuable consideration, for any reason, under any circumstances. This prohibition applies regardless of the category, source, or sensitivity of the information collected. Management Insights Group does not, and will not, monetize client or website-visitor data through sale to data brokers, advertisers, or any other third party.

Management Insights Group may share information with trusted service providers (for example, hosting providers, software platforms, or payment processors) solely to the extent reasonably necessary to perform the services requested by the client, and any such service provider shall be contractually or otherwise obligated to maintain the confidentiality of the information and to use it only for the limited purpose for which it was disclosed. Such disclosures do not, and shall not be construed to, constitute a “sale” of personal information under this Policy or under the TDPSA.

5. DISCLOSURE PURSUANT TO LEGAL PROCESS

Except as otherwise provided in this Policy, Management Insights Group’s sole obligation to disclose your personal information to any third party shall arise upon receipt of a valid, legally binding request issued by a court of competent jurisdiction, or a subpoena, warrant, order, or other compulsory legal process duly issued by a law enforcement agency or governmental authority acting within its lawful authority (each, a “Legal Demand”).

Upon receipt of a Legal Demand, Management Insights Group will review the request to confirm its validity and legal sufficiency and, where permitted by law, will make reasonable efforts to notify the affected client prior to disclosure unless such notice is prohibited by the Legal Demand itself, by court order, or by applicable statute. Management Insights Group will disclose only the information specifically and lawfully required to satisfy the Legal Demand, and no more. Absent a Legal Demand of the nature described in this Section, Management Insights Group will not disclose your personal information to law enforcement, any government agency, or any other third party.

6. COOKIES AND TRACKING TECHNOLOGIES

The Site uses cookies and similar tracking technologies to enhance user experience, analyze site traffic, and understand how visitors interact with our content. Cookies are small data files stored on your device that allow the Site to recognize your browser and capture certain information. You may accept or decline non-essential cookies through the cookie banner presented upon your first visit to the Site, and you may further manage cookie preferences through your browser settings at any time. Consistent with the TDPSA, Management Insights Group will recognize a properly configured, opt-out preference signal (such as Global Privacy Control) transmitted by your browser with respect to the sale of personal data or targeted advertising, to the extent such practices are applicable to the Site. Declining cookies may limit certain functionality of the Site but will not prevent you from accessing our published articles or general content.

7. DATA RETENTION

Management Insights Group retains personal and financial information for only as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide contracted services, satisfy professional accounting and recordkeeping obligations, comply with applicable tax and regulatory retention requirements, and resolve disputes. Upon expiration of the applicable retention period, information is securely destroyed, deleted, or de-identified in accordance with our internal data-handling procedures.

8. YOUR RIGHTS AND CHOICES

Subject to applicable law, you may have the right to:

  • Confirm whether Management Insights Group is processing your personal data, and request access to that data;
  • Request correction of inaccurate or incomplete personal information;
  • Request deletion of personal information, subject to our legal, contractual, and professional recordkeeping obligations;
  • Request a copy of your personal data in a portable, readily usable format; and
  • Opt out of the sale of personal data, targeted advertising, and non-essential cookies or marketing communications at any time.

To exercise any of these rights, please contact us using the information provided in Section 13 below. Management Insights Group will respond to a verified consumer request within forty-five (45) days of receipt, subject to one 45-day extension where reasonably necessary, and will notify you of any such extension. If Management Insights Group declines to act on a request, you may appeal that decision by replying to our determination; if the appeal is denied, you may submit a complaint to the Texas Attorney General’s office.

9. TEXAS DATA PRIVACY AND SECURITY ACT DISCLOSURES

Management Insights Group believes it currently qualifies as a “small business” as defined by the United States Small Business Administration and is therefore generally exempt from the substantive obligations of the TDPSA. As a matter of policy, however, Management Insights Group voluntarily extends the consumer rights described in Section 8 above to individuals who contact us, and, consistent with the TDPSA regardless of exemption status, will not sell sensitive personal data without first obtaining your explicit consent.

Enforcement of the TDPSA is vested exclusively in the Texas Attorney General, and the TDPSA does not create a private right of action. Nothing in this Section shall be construed as a concession that Management Insights Group is subject to the TDPSA, and Management Insights Group reserves all rights and exemptions available to it under applicable law.

10. DATA BREACH NOTIFICATION

In the event of a breach of system security that compromises the security, confidentiality, or integrity of your sensitive personal information, Management Insights Group will notify affected individuals without unreasonable delay and in no event later than sixty (60) days after discovery of the breach, except as necessary to determine the scope of the breach, restore reasonable integrity of the affected system, or comply with a request from law enforcement, in each case consistent with the requirements of the Texas Identity Theft Enforcement and Protection Act, Tex. Bus. & Com. Code ch. 521. If a breach affects at least 250 Texas residents, Management Insights Group will also notify the Texas Attorney General as required by law.

Management Insights Group, LLC (“Management Insights Group,” “MIG,” “the Company,” “we,” “us,” or “our”) values every client relationship and is committed to delivering accounting, business analytics, customer management, donor management, back-office, and annual reporting services of the highest professional quality. This Refund Policy (the “Policy”) describes the circumstances under which a refund of service charges may be issued and the procedure for requesting one. This Policy is drafted to comply with the laws of the State of Texas and should be read together with any signed engagement letter or services agreement between you and Management Insights Group, which shall control in the event of any conflict with this Policy.

1. OUR COMMITMENT TO YOUR SATISFACTION

Management Insights Group will always work to ensure your complete satisfaction with the services we provide. We stand behind the quality, accuracy, and professionalism of our work and are committed to addressing any concern you raise regarding a specific service promptly and in good faith.

2. OUR COMMITMENT TO MAKING THINGS RIGHT

In the event that Management Insights Group falls short of that commitment with respect to a specific service, it is always our intent to make things right. Depending on the nature and circumstances of the shortfall, this may include, without limitation, re-performance of the service in question, correction of the specific deficiency identified, a credit applied to your account, or, if necessary and appropriate under the terms of this Policy, a refund of the specific service charge directly related to the specific service in question.

3. SCOPE AND LIMITATIONS OF REFUNDS

Any refund issued under this Policy is subject to the following limitations:

  • A refund, if issued, shall be limited to the specific service charge directly related to the specific service giving rise to the concern. Management Insights Group does not issue refunds of charges for services that are unrelated to the specific service in question.
  • A refund, if issued, shall be limited to charges billed during the current billing cycle in which the concern is raised and substantiated. Management Insights Group does not issue refunds of charges billed in prior billing cycles.
  • Refunds are issued at the sole discretion of Management Insights Group following a good-faith review of the circumstances and are not automatic or guaranteed upon request.
  • Charges for third-party costs advanced or incurred on a client’s behalf (including, without limitation, software licensing fees, filing fees, or payment-processor fees) are non-refundable once incurred.
  • Fully completed deliverables that have been reviewed, accepted, and relied upon by the client are generally not eligible for refund, though Management Insights Group may, in its discretion, offer re-performance or correction in lieu of a refund.

4. HOW TO REQUEST A REFUND

To raise a concern regarding a specific service or to request a refund, please contact us using the information in Section 8 below as soon as reasonably possible, and in no event later than thirty (30) days following the close of the billing cycle in which the service charge in question was billed. Your request should identify the specific service and billing cycle at issue and describe the basis for your concern in reasonable detail so that Management Insights Group may promptly investigate the matter.

5. REVIEW AND RESOLUTION PROCESS

Upon receipt of a timely request, Management Insights Group will review the matter, which may include consultation with the Client Finance Manager or other personnel assigned to your engagement, and will respond within a reasonable time, generally within ten (10) business days. If Management Insights Group determines that a refund is warranted, the refund will be limited to the specific service charge described in Section 3 and will be issued using the same method of payment originally used, unless otherwise agreed in writing.

6. ENGAGEMENT LETTERS CONTROL

Where a client has executed a separate, signed engagement letter or services agreement with Management Insights Group that includes its own refund, cancellation, or fee-adjustment terms, the terms of that engagement letter or services agreement shall govern with respect to the services covered thereunder, and this Policy shall apply only to the extent not inconsistent with such terms.
